Haven't read the article but come on, if the kernel is not on the main Linux core then how will Google provide the updates? Even if HTC or Samsung open sourced the kernel it is still extremely hard to update it or make it go up to the next version of the Linux kernel. The only hope is when the Android kernel comes 100% compatible with the main Linux kernel, which is happening. But then you got to hope that manufactures write their drivers back to the open source program for it to be a very good experience. But I guess it is a closer step in the right direction?
