Both approaches can have their difficulties, as Tyler Ochoa's discussion of the lawsuits concerning pre-1972 sound recordings illustrated in Ep. 314. Lawmakers have to try to strike a balance: make a law too specific and it won't hold up well over time; make a law too general and it will be misused and might violate Constitutional requirements that laws be narrowly tailored to suit their purposes.
