Re 1) hacking can be both a crime AND a trespass, or either. Re 2) and 3), it would depend on the circumstances, intent, and inclinations of the prosecutors. G+_Dean Albach Posted February 11, 2015 Share Posted February 11, 2015 If the pc was left logged on and open to anybody then going through it is trespassing but if you get past the logon via a hack or password obtained through nefarious means then it is break and enter.
