G+_DeWayne Shorts
In addition to what Wayne Hobbins said. The air over your property is not Your Property. It's all National Airspace. The only right you have to it is what you can actively use. So flying over is not trespassing. Walking on someone's property (at least in IL because I checked) is not criminal trespass unless it is posted clearly at all entry points OR you have been told by the owner previously that you are not allowed on the property. To go one step further down the rabbit hole, even if you do trespass the owner of the property does not have permission to cause damage to you or your belongings except in a case of self defence. As a side note. Local government can not limit where you can and can not fly. The only loophole for them is they can limit where you are allowed to launch, operate from and land. All that being said.... Don't be STUPID when you fly.
G+_Michael Heinz
I believe the judicial precedent is that you have "air rights" to the airspace up to about 500' above what your are using and, in fact, these rights are worth money. https://en.wikipedia.org/wiki/Air_rights
