G+_Michael A. Curtis Posted June 30, 2014 Share Posted June 30, 2014 Anyone can download and repost TWIT It seems that Leo's confused over the legalities of other people’s reuse of TWIT shows. On the most recent episode of TWIT (464) Leo was trying to claim that it is illegal for anyone to download any TWIT show and rebroadcast it. About 20 minutes into the show Leo was stating that because TWIT listener numbers can’t be tracked with such a reuse of TWIT that TWIT has legal recourse when anyone does downloads the show and rebroadcasts it. Has Leo forgotten that TWIT is licensed under a Creative Commons License, specifically CC By NC SA? This license very clearly stipulates that anyone can reuse any TWIT content as long as they attribute the source, don’t use it for commercial purposes, and that any reuse that involves remixing, transforming, or building upon the material must be distributed under the same Creative Commons license. My suspicion is of big content types that grab one download and essentially resell TWiT, if you make a profit off of redistributing TWiT then you are in breach of the creative commons license and should be sued. Jeremy Oelke Leo did mention one guy that was redistributing TWIT shows for a profit but he was also speaking more generally of the act of downloading and reposting TWIT content regardless of commercial gain. Leo's concern was that any reuse, commercial or otherwise, is not trackable by TWIT and that he should have legal recourse if anyone downloads and redistributes the TWIT material. The terms of the license are quite clear: Attribution — You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use NonCommercial — You may not use the material for commercial purposes.
